Please read the following terms, policies and conditions carefully and completely.  You will be required to acknowledge your receipt, understanding and agreement to all prior to booking a room or participating in group activities.

I understand that Posh Life Enterprises, LLC, its affiliates, members, officers, employees, attorneys, staff, volunteers, heirs, representatives, successors, assigns and agents (collectively referred to as PLE) act only as an intermediary and assumes no responsibility or liability and cannot be held responsible for the actions of third parties.  Vendors and property managers, owners and agents have terms and conditions which will be communicated to me and must be adhered to along with governing laws and regulations of the destnation I am visiting. I further agree that I understand taht laws and regulations will vary depending on the country I am visiting Failure to comply with property and activity terms and conditions or to adhere to local governing laws may result in my arrest by local authorities and/or my removal from the property and trip without refund at the sole discretion of PLE.

I, for myself, my heirs, executors, administrators, assigns, or personal representatives, do hereby knowingly and voluntarily release, waive, discharge PLE from liability from any and all rights, claims, or causes of action of any kind arising from my travel and do hereby release PLE from any physical injury or financial loss.  This includes, but is not limited to travel delays or interruption, personal injury, accidents or illnesses (including death), property loss, or damages as a result of travel. 

Assumption of Risks: I understand that domestic and international travel carries inherent risks both known and unknown, including but not limited to personal injury, loss or damage, and death.  I voluntarily assume all risks. I release and covenant not to sue Posh Life Enterprises, LLC, their officers, employees, and agents from or for any and all liability and expense attributable and not limited to any injury, death, property damage, lost wages, economic loss, psychical injury, pain or suffering of any kind due to risks known or unknown arising out of my travel.  This includes activities that may be arranged for the group with third parties. I assume full and complete responsibility for checking and confirming any and all passport, visa, vaccination, or other entry requirements of each destination and all safety or security conditions at those destinations.

Release of Liability: As lawful consideration of, and as part of the payment for a room in the property and as part of the payment for the services arranged for me by Posh Life Enterprises, LLC, I HEREBY EXPRESSLY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND ASSUME ALL OF THE ABOVE RISKS, INCLUDING BOTH THOSE KNOWN AND UNKNOWN TO ME.

Indemnification and Hold Harmless: As lawful consideration of, and as part of the payment for a room in the property and as part of the payment for the services and activities arranged for me by Posh Life Enterprises, LLC,, I HEREBY EXPRESSLY AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS FOREVER Posh Life Enterprises, LLC, its affiliates, members, officers, employees, attorneys, staff, volunteers, heirs, representatives, successors, assigns and agents from and against any liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which I now have or which may hereafter arise out of or in connection with my travel or participation in the activities arranged for me by Posh Life Enterprises, LLC.

I further agree to “indemnify” (meaning to defend and to pay or reimburse) PLE against any claim by any person, arising in whole or in part from an injury or other loss suffered or caused by me in connection with my travel or my participation in activities.

Medical Treatment: I understand that an emergency may develop which necessitates the administration of medical care.  I agree to be financially responsible for any costs incurred as a result of medical treatment. I am aware and understand that I should carry my own medical insurance. I will provide an emergency contact to PLE to assist with medical decisions and care. .  I understand that Posh Life Enterprises, LLC, its officers, employees and agents will not make medical decisions on my behalf and that the emergency contact I provided will assume all responsibility for my treatment, care, and transport home if necessary. 

I further understand the inherent dangers of traveling during a pandemic and take full responsibility and liiability during travel and will hold PLE harmless in the event of exposure.

Identification
Guests are required to make all reservations using their full legal name as printed on their governement issued identification that will be used for travel.. You are responsible for notifying Posh Life Enterprises, LLC of a name change that will impact your travel documents. You understand and acknowledge it is your sole responsibility to make all necessary changes to travel documents and planning if there is a name change.

Media Release: I understand that ALL video and photos taken during booked travel and excursions by hired photographers and/or agents of Posh Life Enterprises, LLC are the sole property of and copyright is owned by Posh Life Enterprise, LLCs and may be used in perpetuity and without restriction on websites, social media pages in print or in any other way at the sole discretion of Posh Life Enterprises, LLC.  Posh LifeEnterprises, LLC reserves the right to publish and use all photos taken without restiriction or payment and has my consent to do so.  In addition, I consent to the use of all photos I pose for as well as candid shots taken by guests and shared with Posh Life Enterprises, LLC in perpetuity and without restriction,

SPECIAL NOTICE REGARDING COVID-19: I understand the ineherent risks and dangers of travelng during a pandemic and assume full responsibilty and liability.  I understand it is my sole responsibility to know and follow all travel and legal requirements related to COVID.  I understand that I am required to notify Posh Life Enterprises, LLC of a positive COVIID test. I understand that a positive COVID test will restrict m from traveling on the booked trip due to the intimate environment and danger to the health of other guest. A positive COVID test will not chane the non-refundable policy, and I undersand and acknowledge that I must purchase the appropriate travel insurance to cover my expenses in the event my travel must be canceled due to a positive COVID diagnose. In the event that I must cancel my trip due to COVID, I underrstand I will need to file a claim with my travel insurance company for reimbursement and will not seek reimbursement from Posh Life Enterprises, LLC.

Cancellation, Name Change and Refund Policy
In order for Posh Life Enterprises, LLC to offer stable and consistent rates to all clients regardless of cancellations or trip interruptions and due to contractual obligations with hotels, property management furns and owners, airlines and other vendors, deposoits and all subsequent payments are non-refundable. Though payments are non-refundable, they may be recoverable through the name change process detailed below if a guest is approved to assume your resevation by the name cange policy deadline. Deposits are not recoverable under any circumstances.

While Posh Life Enterprises, LLC understands that circumstances may occur outside of your control that may affect your ability to take a planned vacation, the non-refundable policy will be strictly adhered to.  It is highly recommended that you purchase travel insurance with the appropriate coverages so that you are protected in these circumstances. Posh Life Entrprises, LLC will not assume liability in the event you do not purchase the necessary travel insurance to protect your travel investment. The non-refundable and name change policies will be strictly enforced. Posh Life Enterprises, LLC takes no responsibility for your trip interruptions or cancellations and you will be solely responsible for any and all losses incurred.  Each trip will have the cancellation and name change policy stipulations notated and these policies will be strictly adhered to for all clients.  

If you are traveling with a roommate and they cancel their trip, you are solely responsible for finding a new roommate to assume their cost or you will be responsible for the balance due. If a single occupancy rate is available, your rate will be adjusted to the single occpancy rate and all funds paid by your roommate, with the excpetion of the non-refundable deposit, will be applied to your booking.

Due to the intimate nature of the properties, all name changes must be approved by an agent of Posh Life Enterprises, LLC. If you decide to transfer your room, please reach out to us at info@poshlife365.com for immediate assistance.

Reservation Reinstatement
Once you have cancelled your reservation, you have 48 hours to notify us that you would like to reinstate your reservation. There is a reinstatement fee of $50 for domestic travel and $100 for international travel, due upon request of reinstatement. If there is still space available, your reservation will be reinstated upon receipt of the reinstatement fee and all payments made, including deposit, will be applied to your reinstated reservation.

Name Change Process 
It is your sole resohsibiliry to find a gueat to assume your reservation in the event you need to cancel you travel plans. Name change requests must be submitted via email at info@poshlife365.com. Upon receipt of your name change request, if you are unable to locate a guest/guests to assume your reservation, your room will be made available to PoshLife365 group members and on the website after all available and comparable inventory has been booked.  While every effort will be made to assist you , Posh Life Enterprises, LLC makes absolutely no guarantees that we will be able to identify a guest to assume your reservation. It is highly recommended that you purchase travel insurance with adequate coverage to reimburse you in the event you need to cancel your travel plans. If you have a guest willing to assume your reservation, and they are approved by a Posh Life Enterprises, LLC representative, your room will immediately be transferred to that guest regardless of rooms currently available for booking.

Name Change Request Steps

If you have identified a guest to assume your reservation
1. Send an email to info@poshlife365.com to request a name change before the published name change deadline. 
2. Include their name, email address and telephone number in the email as well as any social media pages they own for review.
3. Have them complete the Trip Registration Form and click the button for name change approval.
4. Due to the intimate nature of our travel, guests must be reviewed by a Posh Life Enterprises, LLC representative, who will notify you if the name change request has been approved. Approval is at the sole discretion of Posh Life Enterprises, LLC.
5. Guests will be reviewed for approval and a response provided within 3 business days of receipt of the Trip Registration Form. 
***Please note that guests who have been previously banned from group travel with PoshLife365 are ineligible and will not be approved***
5. Upon approval, the new guest will be required to pay the non-refundable deposit and assume all payments still due on the reservation. Note that your deposit remains non-refundale and will not be applied to the assumed reservation. For example, if you paid 4500 and $100 of that amount was your non-refundable deposit, you should only collect $400 from the guest assuming your reservation. Please refrain from attempting to collect your non-refundable deposit from the new guest. This amount remains non-refundable and is inelegible for recovery using the name change policy. Failure to abide by this policy will result in you being permanently banned from travel with PoshLife365.

If requesting assistance with finding a guest to assume your reservation
1. Send an email to info@poshlife365.com by the Name Change Policy deadline noted in trip details notifying us of your cancellation and requesting assistance with finding a guest to assume your reservation.
2. A Posh Life Enterprises, LLC representative will contact you within 48 hours to acknowledge receipt of your cancellation and request for assistance and review next steps.
3. Your space will be offered to PoshLife365 members and on the website once all comparible inventory has been booked.
4. Though Posh Life Enteprises, LLC will make every effort to assist you with finding someone to assume your reservation, we can make no guarantee that a guest will be idenfited to assume your reservation.

Private Property Disclaimer

Posh Life Enterprises, LLC specializes in locating amazing privately owned properties all over the world through our vast network of brokers, property management firms, and private owners.  The rental of private properties gives us an amazing experience and many times allows us to connect with local citizens more deeply to truly immerse ourselves in the culture.  You will be expected to be respectful of all staff and to conduct yourself in accordance with all communicated property rules and guidelines as well as local laws and regulations.  With private properties, imperfections should be expected.  Furnishings and decor may change from posted photos and there may be repairs needed during teh course of our stay.  If there is an egregious difference from the property description or an issue at the property, Posh Life Enterprises, LLC will work with the property manager or owner to resolve the issue.  Under certain circumstances, we may find it necessary to move the trip to another comparable property either temporarily or for the full duration of the trip and you ackowledge and agree that we reserve the right and sole discretion to do so with your full authorization upon booking. Posh Life Enterprises, LLC assumes no liability for injuries or incidents, including death, that occurs on property grounds.

Excursion and 3rd Party Vendors

Posh Life Enterprises, LLC plans and schedules excursions and activities as a courtesy to the group as a part of itinerary planning and to obtain group discounts and private options on behalf of atttendees. However, these services are not provided by Posh Life Enterprises, LLC and all liability and responsibility lies with the 3rd party business or vendor that provides the service or activity. Posh Life Enterprises, LLC makes no guarantees and takes no responsibility or liability for services rendered by 3rd parties. If there is an issue with a 3rd party vendor, as a courtesy, Posh Life Enterprises, LLC will attempt to come to a reasonable resolution on behalf ofthe group, but cannot guarantee an agreeable outcome to he dispute. All dispute resolutions, liability, and responsibility lies with the 3rd party business or vendor.

Roommate Matching
You are solely responsible for locating a roemmate if you would like a double occupancy rate. However, as a courtesy, Posh Life Entprirses, LLC will make every attempt to match you with a roommate from the PoshLife365 travel group if possible. We cannot guarantee that a roommate will be identified, and you acknowledge that finding a roommate is your responsibility and you will be charged a single occupancy rate if a roommate is not identified.

Late Payments
Please make every effort to make your payments in a timely manner no later than the payment due date. Late payments negatively impact all aspects of travel planning and should be avoided. Payment that are over 5 days past due will be assessed a $25 late fee.

Travelers with Disabilities
Travelers with disabilities must do your due diligence in selecting travel that is suitable for your physical abilities. Please note that some countries and international tour operators will not provide handicap accessibility. If you requirs personal assistance to travel, please notify us at info@pohlife365.com for review. Upon approval, you must be accompanied by someone who can provide 100% of your necessary assistance and your companion must pay the full rate for the reservation. You acknowledge and agree that Posh Life Entpririses, LLC and its representatives will at no point be responsible for assisting you in any way. Posh Life Entprises, LLC reserves the right and sole discretion to reject participation in any travel or activites that we deem unsafe or that would impede our ability to serve all guests in attendance. You acknowledge and understand that Posh Life Enterprises, LLC is not responsible or liable for the international laws and regulations or any lack of accessibility encountered.

Service Animals
Service animals cannot be accommodated on international travel. For domestic travel, it is your sole responsibility to notify us of the need for a service anmal at the time of booking.
